DRAFT – a lawyer must review before launch
Written in plain words from how Fireville works today. It is not final and not legal advice. Highlighted [BLANKS] must be filled in by the lawyer.
The short version
- Every bid is a binding promise to buy. When you win, your saved card is charged automatically.
- Fireville's server clock decides who won, not your screen.
- Shill bidding (sellers or their friends bidding up their own items) is banned.
- Shows can end by themselves, and Fireville can pause, end or cancel any show or result.
This summary helps you read the policy; the full text below is what applies.
On this page9 sections
1.What happens in a show#
A live show is a seller's video stream where they sell items by auction or Buy now, run free giveaways and, where offered, Fire Pulls. Shows are public: anyone with the link can watch. Practice shows are marked as practice, and nothing in them is real money or binding.
2.Bids are binding#
Placing a bid is a binding offer to buy the item at that price plus shipping, the order protection & processing fee and any tax. If you're the highest bidder when the timer ends, you've bought it. There are no takebacks for mistaken or accidental bids, so check the amount before you tap.
You must have a valid card and shipping address on your account to bid. We may set bid limits for new accounts or after failed payments.
3.How the timer works#
Sellers choose the auction length (from 2 seconds up to 60 minutes) and may turn on Overtime: a bid in the last seconds resets the timer to between 2 and 10 seconds, as the seller sets, so others can respond.
The highest valid bid recorded by Fireville's servers when the timer reaches zero wins. Ties go to the earlier bid. Your screen, your connection and video delay can be behind real time; Fireville's record is final. We aren't responsible for bids that didn't arrive because of your connection or device.
4.Paying for wins#
When you win, your saved card is charged automatically for the win. Wins from the same seller in the same show ship together in one box, and shipping is worked out per box (the bid area shows what this win adds). If the charge fails, you can't keep bidding or chat in that show until it's paid, and an unpaid win may be cancelled when the show ends. Repeated unpaid wins lead to suspension.
5.Marketplace auctions#
Sellers can also list a single item as an auction in the marketplace, running from 1 to 14 days. Bids there are binding too. A bid in the last 2 minutes pushes the end time back 2 minutes, so others can respond. When the auction ends, the highest bidder wins and their saved card is charged automatically. If that charge fails, the winner must pay within 3 days of the end, or the win is cancelled and the seller may relist the item.
6.Rules for sellers in shows#
- Show each item on camera and describe it truthfully before or while it's up for sale.
- Never bid on your own items, and never let staff, family or friends bid to push the price up (shill bidding).
- No fake viewers, bots, fake urgency or fake chat.
- Once an auction has a bid, don't cancel it or swap the item. Sell the item shown to the winner.
- Don't show buyers' personal information on stream.
- Run giveaways exactly as announced; they're always free to enter.
7.When things go wrong#
If a bug, outage or video problem affects an auction, or if we believe rules were broken, Fireville may pause the show, void the result, re-run the auction, cancel the order and refund the buyer. We may also cancel results won by accounts we believe are fake or connected to the seller.
8.Ending shows#
Shows can end by themselves after they've been idle for a while. Fireville can end, cancel or remove any show, with a reason, at any time. A show can't end while a giveaway or auction is still running. Unpaid wins in a cancelled show are cancelled.
9.Recording#
Shows may be recorded and short clips kept as video receipts of auctions, pulls and giveaway draws. We use them for disputes, safety and promotion as the Terms describe.
