Terms of Service

Draft. Written in plain words from how Fireville works today. A lawyer reviews it before launch.

1. Who we are

Fireville is an online marketplace where people buy and sell trading cards and collectibles through live auction shows, Buy-now listings, giveaways and short videos (Sparks). Fireville is the platform: the seller of each item is the person or shop that listed it, not Fireville, unless the item is sold by the official @fireville account.

By creating an account or using Fireville you agree to these Terms and to the policies linked from them (Privacy, Seller Rules, Buyer Protection, Prohibited Items, Community Guidelines, Shipping, Fees, Giveaway Rules, Fire Pulls, Text Messages and Copyright). If you don't agree, don't use Fireville.

2. Who can use Fireville

You must be 18 or older and live in the United States. You may have more than one account (for example a separate buying account), but rewards can't be stacked across them: no inviting your own accounts, no extra welcome or card bonuses, and only one person's share of giveaway entries. You must give true information, keep your phone number current, and keep your login safe. You're responsible for everything done on your account.

We can refuse, limit, suspend or close an account that breaks these Terms or puts buyers, sellers or Fireville at risk.

3. Buying

A winning bid or a Buy-now purchase is a binding agreement to buy. When you win, the card saved on your account is charged automatically for the item, shipping, the order protection & processing fee and any tax.

Orders are final. Before an order ships you can ask to cancel it; the seller decides. If a seller asks to cancel, you choose to accept (full refund) or not. Problems with an order are handled under the Buyer Protection policy.

If a payment fails you can't bid or chat in that show until it's paid. A win that's still unpaid when the show ends is cancelled.

4. Selling

Selling needs an approved application. Sellers agree to the Seller Rules and the Fees policy, verify their identity with Stripe before their first payout, and ship every sold item within their handling time.

Sellers are responsible for describing items honestly, for the items they sell, and for any taxes they owe on their income.

5. Payments and payouts

Payments are processed by Stripe. Fireville collects the buyer's payment, keeps its fees and pays the seller the rest through Stripe Connect once the order is delivered and any hold period has passed.

Fireville can hold an order's money while a support case or chargeback is open. If a seller is paid for an item they don't ship, or owes refunds, chargebacks, carrier adjustments or fees, their balance can go negative. Sellers must pay a negative balance; Fireville can take it from future sales, charge the seller's saved payment method, or send unpaid balances to collections with the collection costs the law allows.

6. Rewards, giveaways and Fire Pulls

Fireflies are Fireville rewards (100 Fireflies = $1 to spend on Fireville). They have no cash value, can't be bought, sold or transferred, and can be removed if earned by fraud or a refunded order. We can change how Fireflies are earned or end the program with notice.

Giveaways are always free to enter and follow the Giveaway Rules. Fire Pulls and Ember Drops follow the Fire Pulls policy: every possible prize is listed with its odds before anyone bids.

7. Your content

You own what you post (Sparks, photos, chat, listings). You give Fireville a license to show, store, copy and promote it on Fireville and in Fireville's marketing while it's up and for a reasonable time after. Don't post anything you don't have the right to post. We can remove content that breaks our policies.

8. Things you can't do

Take or ask for payment outside Fireville; sell prohibited, fake or misdescribed items; shill bid (bid on your own items or have friends bid them up); harass anyone; make fake accounts, invite your own accounts or stack rewards across accounts; scrape, hack or overload the app; or use Fireville for anything illegal. See the Prohibited Items and Community Guidelines policies.

9. Disclaimers and limits

Fireville is provided as is. We work hard to keep it running and safe, but we don't promise it will always be available or error-free, and we don't guarantee any item's value, grade or future price.

To the extent the law allows, Fireville isn't liable for indirect or consequential losses, and our total liability for any claim is limited to the fees Fireville received from you in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.

10. Disputes

Most problems are solved fastest through Help → Contact support. If a dispute can't be solved that way, the lawyer-reviewed final version of these Terms will say how it is resolved (for example arbitration and the governing state's law). This section is a placeholder until then.

11. Changes

We may update these Terms. If a change is important we'll tell you in the app before it takes effect. Using Fireville after the change means you accept it.

Questions? Open Help → Contact support in the app, or email support@fireville.app.
